What rights does tenants have at the end of thier lease if they want to renew it?
I’m having a problem with the tenant downstairs (I live in the upstairs Apartment). My Lease is up next month and the landlord keeps telling me not to worry, He will renew my lease. The downstairs tenant does what ever she wants, Loud Music, Parties all night, even has strange visitors all hours of the night, (possible drugs are involved). Just recently I was up at 6am getting my son up for his day for a tournament, when she went to her basement and turned my circuit breakers OFF. (I’ve notified the Police, and they got involved). She tells the Landlord that I’m the one that starts everything which isn’t true. She has Illegal tenants staying with her and on numerous occasions I’ve caught them smoking Crack & Pot outside the dwelling. I know that the option of moving is there, but if I do it would disrupt my son last year in High School. Can someone tell me the Legal aspects of this and how I could go about doing this? I live in NJ. I pay my rent on time every month and in Cash. She is on assistance and on food stamps, Welfare, and HUD. Should I contact an attorney?

you may renew lease if you and landlord can agree to terms again. the landlord does not have to renew and can raise the rent if they choose. the fact you are a current tenant gives you no preferential treatment
this does not sound like a good environment for your son. a move is not a bad thing here.
If they are committing crimes (like crack), then call the police.

Wow. I was in this EXACT same situation. Crazy crackhead lived below me and gave me grief constantly. Had police involved a number of times. Even had a mediation meeting with the apt manager. In the end, I ended up moving to a single level apt in the same complex. You should do somewhat of the same, and heres why:
You are already on bad terms with this woman so you may be able to renew your lease, but the problem with her will continue. Trust me, that is no way to live. Issue after issue will continue to come up with a woman like this and the stress of it is simply not worth the principal of it. You can call the police or the state housing authority to report her doing things but unless you have proof, its a lot of she said/she said.
Im honestly trying to save you some time and grief here. You may win against this woman in the long run, but your misery in the mean time will be a high price to pay.
