I am failed financially and about to seek protection under the bankruptcy law. I run up credit card bills while being married to my to-be-ex-wife, but I don’t want her to be responsible for my failure. Should I file BK before or after divorce is finalized? How can I be sure my creditors wont go after my ex-wife just because we were married when I over-extended myself? Also, I’d like to be sure that her credit wont be killed because of me. Thanks.

OK this is a complicated situation for me. I knew a guy for a few years. I basically fell in love with him and he knew that. We went to Las Vegas for work and after everything we ended up getting married in one of those little white wedding chapels. I had been drinking, him not so much. Well anyway we go back to NJ (where we both live) and try to work this out. A couple months later we get into a fight and he leaves for Atlanta. Come to find out he slept with his ex-girlfriend and got her pregnant. I found this out about 8 weeks later. Friends have told me that he said he married me to better his career and that he said it looks better in his company *insert eyeroll*. After that I decided I want a divorce. He refuses to sign the papers. I filed as Irreconcilable Differences. I’m not asking for anything of his. Just for him to sign the papers. I can’t afford a top shelf attorney like him so my lawyer isn’t really that much of a help. Is there anyway I can force him to sign the papers? Any suggestions please? I just want out of this marriage.
Also once I get him to sign the papers, since I’m not asking for anything and I’m sure he doesn’t want anything of mine, how long before the divorce is finalized?

I was married to an abusive man. I obtained a restraining order and a divorce and since remarried and moved out of STATE. His new girlfriend said I was "stalking her" because I drove past there house, watched her kid get on a bus..etc. I hired a lawyer the first time and the case was dissmissed because they didnt serve me properly. They reapplied and added another phantom charge to make this law "stick" and I have to go to court 520 miles away from my home and in the discovery my ex husband said I am trying to get a RESTRAINING ORDER ON HER (Me) and if I cant which he couldnt in the STATE of NJ because he was the abuser not me they didnt grant it to him…then we will proceed in this munciple court on stalking! Any sug? I do not have a record and need your advice please…How do I act what do I say or not say because now I cannot afford an attorney…Thank You

I had a post nup agreement written up to protect any inheritance I may receive. My husband and I also have a pre-nump agreement. I know how ridiculous this sounds - why did we bother getting married.

However, after I contacted my lawyer, I found out that inheritances were not considered marital property in a divorce. So I really didn’t need to have this post nump agreement written up. Then, I got a whopping bill for 0 from my lawyer for "consultation" and fees. The consultation was maybe a five minute phone conversation.

I also emailed my lawyer to ask him what protection the post nump provides me beyond basic property rights. He responded and said that my inheritance was protected under property rights and the prenump would have covered it anyway.

What the heck???? So now I owe this guy 0 for an agreement that he didn’t even have to draft? Should I lick my wounds and just pay him or confront him and tell him that he took advantage of my ignorance. He should have counselled me differently and told me that this agreement was not necessary.

I have over 0,000 in debt because of a divorce, I must file! Do I need an attorney, or is it safe to use a document preparer to assit with the filing? I hear arguments on both sides. An attorney wants 00 to do a ankruptcy.

I have been seperated since July. My Divorce was finalized in October. We owned a house together from Jan - July. Would it be beneficial to go to the same accountant? Or is that pointless? I prefer not to see her, but could suck it up for an hour.

One of my friends is going through a divorce and her lawyer charges 0 per hour!!! Is that normal? How do lawyers justify charging so much money per hour when people normally make -20 per hour? Just really curious about this.
