I’m afraid if he owes the IRS money that I won’t get much money myself when it comes time for me to file child support in June.

Currently there are no federal tax laws that support responsible single parents who do not have full custody of their childeren. Which ever parent has them the most out of the year can claim all of them. I don’t see how this can be fair. If child support is paid, the parent paying it pays the income taxes on it and it is included in their income. The parent recieving the support does not show it as income nor do they have to pay taxes on it. I dont understand why responsible single parents who are in their kids lives and are supporting them financially can not utilize a deduction at all. So I guess my question is… What is the route a person has to take in order to change the current tax laws to show some equality and recognition for those of us showing responsibility with their parental duties?
My children do not live with me but I pay their mother child support. Can I claim or deduct this from my federal taxes? What kinds of tax-sheltered or tax-deductible savings accounts can I open for them? Is there a site I can check out that would give me information on bettering my tax position based on my situation?
I would like to know why the government do not allow tax deduction or tax credit for those paying child support, But on the other hand gives a child tax credit to the custiodal parent? I think child support was just a way to correct a government policy that went wrong. You promises theses single mothers theses government programs and now that the government can not afford it, lets deduct the standard of living for some else. That is probably the reason we are continuing to have the pro-life versus the pro-choice debate, because some appointed officals decided on a social policy that was taken out of the democratic processes. Also, why is child support gender base? Why do a judge makes the assumption that it is in the best interest of the child to be with the mother, where was this research perform to give this basis? Also, where in the constitution that gives the government the right to throw you in jail if you can not pay a debt, that is not a tax? Just my opinion.
For example, a plaintiff wins in small claims and the defendant files for bankruptcy. As I understand their slate is wiped clean and no longer owe the judgement, how is this justified?
Obviously it’s a cop out, but why does the law allow it, what’s the laws justification for allowing this?
Why can someone file bankruptcy and still owe child support but not owe a court order judgment?
I am attempting to show the courts that I have hired 3 attorneys over the course of 5 years to modify child support. Only one of those attorneys ever brought the case to court - THIS YEAR - at which point I was told by the judge that to modify my support would be like rewarding me for not paying.
Before everyone decides to massacre me for being a "deadbeat" there are many, MANY facts you would have to know. Like the fact that I have my child almost 50% of the time & that the father makes a LOT of money, his wife stays at home with NO kids at home & doesn’t work though she has a teaching degree. I am also a stay-at-home mom to 3 kids, 2 of whom are very young.
I need to get my files from the former attorneys who never did anything for me but I want to get them without giving them notice so that they don’t have a chance to take anything from the files.
HOW CAN I DO THAT?
I have primary physical custody and have paid ALL of her uncovered medical and dental, food, clothing, educational, and housing needs for her whole life. Ex has paid very little voluntary child support and was only court-ordered to provide support recently. None of the other settlement points address educational fees or the K in back child support we are owed. I hate the idea of going to trial, but I am leery about signing over the tax exemption for all of the reasons listed above. Any advice?
I put my ex-husband on child support sometime last September. His daughters mother put him on sometime last May. We’ll he called me pissed off because he got all his taxes taken away from him when he filed for owing child support. We both live in Virginia but his other daughters mother lives in Illinois. How do they disperse his taxes? Do they just pay off which ever person he owes more or am I the only one getting the back child support because he filed in Virginia? Or will they split the money?
